Terms of Service

The rules and expectations that govern your use of the Platform.

1. Acceptance of Terms

By creating an account or using any part of TheBooth.Club (“the Platform”, “we”, “our”, or “us”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms form a legally binding agreement between you and Booth Club, operated from India.

2. Eligibility

You must be at least 13 years old to use Booth Club. By using the Platform, you confirm that:

  • You are at least 13 years of age.
  • If you are between 13 and 18, you have obtained parental or guardian consent.
  • You have the legal capacity to enter into a binding agreement.

We reserve the right to verify eligibility and suspend or remove accounts that do not meet these requirements.

3. Your Account

When you create an account, you agree to:

  • Provide accurate and truthful information during registration.
  • Keep your account credentials secure and confidential.
  • Notify us immediately at info@thebooth.club if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

You may not create multiple accounts to circumvent bans or platform restrictions.

4. User-Generated Content

You retain ownership of the content you create and post on Booth Club - including posts, takes, and replies (“Your Content”).

By posting content on the Platform, you grant Booth Club a non-exclusive, worldwide, royalty-free licence to display, distribute, and transmit Your Content solely for the purpose of operating and improving the Platform. This licence ends when you delete your content or account, except where content has been shared or interacted with by others.

You represent that you have the rights to post any content you submit, and that doing so does not violate any third-party rights.

5. Platform Rules

Booth Club is a space for thoughtful, music-focused conversation. You agree not to:

  • Post content that is hateful, discriminatory, threatening, or harassing toward any individual or group.
  • Share content that is defamatory, obscene, or in violation of applicable law.
  • Infringe on the intellectual property rights of others (including copyright and trademarks).
  • Spam, flood rooms, or post repetitive content intended to disrupt the community.
  • Impersonate another person or entity, or misrepresent your affiliation.
  • Attempt to gain unauthorised access to the Platform, its systems, or other users' accounts.
  • Use automated tools, bots, or scrapers to access or extract data from the Platform.
  • Use the Platform for commercial solicitation without prior written consent.
  • Engage in any activity that violates applicable Indian law or the laws of your jurisdiction.

You are solely responsible for the content you post. Booth Club acts as an intermediary platform and does not endorse, verify, or assume liability for any user-generated content. If your content violates these rules, applicable law, or the rights of any third party, you bear full legal responsibility. Other users may report content they believe violates these Terms, and we will act on reports at our discretion.

6. Moderation & Curator Accountability

We reserve the right, but not the obligation, to review, edit, or remove any content that violates these Terms or that we determine, in our sole discretion, is harmful to the community or the Platform. We may also suspend or permanently ban accounts that repeatedly or seriously violate these Terms, without prior notice. We are not liable for any content posted by users, but we take our role in maintaining a healthy space seriously.

Curator Accountability: Curators who earn elevated privileges (room creation, pinning, highlighting) are held to a higher standard. The Platform computes a Curation Score based on the quality of editorial decisions, room engagement, and personal contributions. Curators whose score falls below acceptable thresholds during their probation period may have their curator status revoked automatically. This system exists to ensure that curator privileges are earned and maintained through demonstrated quality, not merely granted.

Invite Quality: Members who invite others into the Platform bear responsibility for the quality of their invitees. New members go through an evaluation period during which their contribution quality is assessed. Inviters may see their reputation and invite privileges affected by the quality of people they bring in.

7. Intellectual Property

All content, design, logos, and features of the Platform that are not user-generated are the property of Booth Club and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on Platform content without our prior written permission.

8. Third-Party Services

The Platform relies on third-party infrastructure and service providers (such as authentication, hosting, analytics, and email services). Your use of the Platform may be subject to their respective terms and policies. We are not responsible for the practices of these third parties beyond what is described in our Privacy Policy.

Spotify: The Platform uses the Spotify Web API to provide song search and display album artwork. Spotify content (including track names, artist names, and album artwork) is provided by Spotify and remains the property of Spotify and its licensors. You agree not to copy, reproduce, or redistribute Spotify content outside the Platform. Spotify AB is a third-party beneficiary of these Terms and is entitled to directly enforce them against you.

PostHog: We use PostHog for product analytics to understand how the Platform is used. PostHog may collect usage data as described in our Privacy Policy and Cookie Policy.

Vercel: The Platform is hosted on Vercel. When you access the Platform, Vercel may automatically provide us with your approximate geographic location (country, city, region) derived from your IP address. This data is stored in your profile for aggregated analytics purposes only.

9. Limitation of Liability

The Platform is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Booth Club and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including but not limited to loss of data, loss of reputation, or loss of profits.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim (which, at the current free-access stage, is zero).

10. Termination

You may delete your account at any time by contacting us at info@thebooth.club.

We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, pose a risk to other users, or for any other reason at our reasonable discretion. Upon termination, your right to use the Platform ends immediately. Provisions of these Terms that by their nature should survive termination will do so.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India. If any provision of these Terms is found to be unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify users via the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
